طوبى الائتمانية: قراءة نقدية للدرس المقاصدي في فكر د. طه عبد الرحمن
Résumé: يهدف المقال إلى تقديم قراءة نقدية لأفكار الدكتور طه عبد الرحمن في مبحث مقاصد الشريعة، باعتبارها أحد أهم محاولات المدارسة التجديدية لهذا المبحث من خارج المدرسة الأصولية وفي الإطار الواسع للفكر الإسلامي المعاصر، والأسئلة التي يروم المقال الإجابة عنها: ما الجديد التي قدمه فيلسوف الائتمانية للمقاصد؟ وهل في إمكان فلسفته الائتمانية أن تجيب عن الإشكالات الكبرى التي ما فتئت تتناسل حول الشريعة ومقاصدها؟ وكيف يمكن للقراءة الناقدة لهذا المشروع الرائد أن تطور البحث العلمي في هذا الفرع الهام من فروع المعرفة الإسلامية؟ The article aims to present a critical reading of the ideas of Dr. Taha Abdel Rahman in the topic of Purposes of Sharia, these ideas which are one of the most important attempts to regenerate this science from outside the fundamentalist jurisprudence school. The questions that the essay tries to answer are: What is new that the philosopher, Dr. Abd al-Rahman, presented to the knowledge of Qased Sharia? Is it possible for his moral philosophy to answer the major problems that arise over the law and its purposes? How can critical reading of this important project develop scientific research in this important branch of Islamic knowledge?
