Résumé: تهدف هذه الورقة البحثية إلى إعطاء تصور حقيقي عن الآليات والميكانيزمات المتاحة لشركة المساهمة، التي تمكنها من شراء الأسهم، سواء تعلق الأمر بشراء أسهمها ، أو بشراء أسهم شركة أخرى،كما تسعى لإرساء الإطار الفعال لها، لمواكبة التطورات الراهنة التي يشهدها الاقتصاد العالمي من جهة، وما تشهده التشريعات المنظمة لشركات المساهمة من تغيرات من جهة أخرى. This research paper aims to give a real perception of processes and mechanisms available to the joint stock company which enables it to buy shares, whether the purchase of its own shares, or the purchase of shares of another company. It also seeks to establish an effective framework, on the one hand, to cope with the current developments in the world economy, and on the other hand, the changes occurring in the legislation governing joint stock companies.
