حماية الأهداف المدنية في النزاعات المسلحة الدولية

Résumé: تناول هذا البحث موضوع حماية الأهداف المدنية في النزاعات المسلحة الدولية، إذ عالج فيه الإشكالية الآتية: إلى أي مدى تطابقت حماية الأهداف المدنية في النزاعات المسلحة الدوليةبين نصوص الشريعة الإسلامية والاتفاقيات الدولية؟،وذلك في مبحثين اثنين ، حيث تطرقالمبحث الأوللماهية حماية الأهداف المدنية في النزاعات المسلحة الدولية ، وأما المبحث الثاني فقدعرض أهمصور حماية الأهداف المدنية في كل من الفقه الإسلامي والقانون الدولي الإنساني، ثم بين إنتهكات بعض الدول لها زمن النزاعات المسلحة الدولية،وتوصلالبحثفي خاتمته إلى نتائج أهمها: أن الإسلام سبق الاتفاقيات الدولية في مجال حماية الأهداف المدنية بكل صورها، وتكريس مبدأ التمييز بين المدنين والعسكرين، وبين الأعيان المدنية والأعيان العسكرية، وعدة توصيات أهمها: ضرورة تطبيق ما أقرته الشريعة الإسلامية من أحكام في النزاعات المسلحة الدولية، وخاصة ما يتعلق بحماية الأهداف المدنية؛ لأن أحكامها صالحة لكل زمان ومكان ولقد جاءت للناس كافة دون تمييز بسبب لون أو جنس أو دين. This research dealt with Protection of Civilian Objectives in International Armed Conflicts, in which it addresses the following problem: To what extent is the protection of civilian objectives in international armed conflicts compatible between the texts of Islamic Sharia and international agreements? And that in two sections, the first topic dealt with the nature of the protection of civilian objectives in international armed conflicts, and the second topic presented the most important images of the protection of civilian targets in both Islamic jurisprudence and international humanitarian law and between violations by some countries during the time of international armed conflicts, and the research concluded with the most important results for instance, Islam preceded international conventions in the field of protecting civilian objects in all its forms, and established the principle of distinction between civilians and soldiers, and between civilian objects and military objects, and several recommendations, the most important of which are: The necessity of applying the provisions of Islamic Sharia in international armed conflicts, especially with regard to the protection of civilian objects ; Because its rulings are valid for every time and place, and they came to all people without discrimination because of color, gender or religion.
