ضوابط التقصيد الجزئي للحديث النبوي

Résumé: ملخص: اتفق العلماء على أهمية استحضار مقاصد الشريعة الإسلامية في فقه الأحاديث النبوية، ولذلك لزمنا التوصل إلى المقصد الصحيح بالحجة الساطعة، ومن هنا جاء هذا البحث ليجيب عن الإشكالية الآتية، وهي: ما الضوابط التي نستند إليها في التقصيد الجزئي للحديث النبوي ؟. وقد انتهى البحث إلى إبراز ستة ضوابط مهمة، هي كالآتي: ثبوت الحديث - ثبوت لفظ الحديث - الانسجام مع علة الحديث النصية - مراعاة الدلالة اللفظية للعلة المنصوصة - مراعاة السياق المقالي والمقامي للحديث - جمع النصوص الحديثية الواردة في المقصد الشرعي الجزئي. وقد مثلت لها بأمثلة تراوحت بين القديم والمعاصر بغية لفت النظر إلى ضرورة استصحابها في الشرح الحديثي المعاصر. Abstract: The scholars are unanimously agreed on the importance of the objectives of maqasid al-sharia in understanding the hadith, and that is why the objectives must be reached with strong evidence, and this research came to answer the following question, which is: What are the guidelines that we use in deducing the partial objectives of the hadith? The research has concluded six controls, which are: Proof of Hadith - Proof of the words of the hadith- Harmony with the Illness of Hadith - Observance of the Verbal Significance of the Bug - Taking into account the context of the Hadith - Collection of Hadiths in the partial Sharia intent. The research came with old and new examples in order to demonstrate their value in explaining hadith in this era.
