أثر تطبيق المحاكمة عن بعد على ضمانات المتهم.

Résumé: استعمل المشرع الجزائري المحادثة المرئية عن بعد أثناء الاجراءات القضائية، حيث يعد اجراء جديد تم من خلاله ادخال تقنية المحادثات عن بعد بالصورة والصوت بموجب القانون رقم 15-03 المؤرخ في 1 فبراير 2015 المتعلق بعصرنة العدالة، حيث كان هذا الاجراء مطبقا بصفة محتشمة. و مع انتشار جائحة كورونا في الجزائر تم الاعتماد على هذا الاجراء بشكل واسع في أروقة المحاكم والمجالس والمؤسسات العقابية خلال فترة الحجر الصحي الذي عرفته البلاد ، حيث صدر في هذه الفترة الأمر رقم 20-04 المعدل لقانون الاجراءات الجزائية. الكلمات المفتاحية : المحادثة المرئية عن بعد، المتهم، التحقيق، المحاكمة العادلة. Abstract: The Algerian legislator used remote video chat during judicial procedures, as it is a new procedure through which the technology of remote conversations with image and sound was introduced under Law No. 15-03 of February 1, 2015 related to the modernization of justice, where this procedure was applied in a modest manner. With the spread of the Corona pandemic in Algeria, this procedure was widely relied upon in the corridors of courts, councils and penal institutions during the period of quarantine that the country knew, as during this period Order No. 20-04 amending the Code of Criminal Procedure was issued. key words: Remote video chat, the accused, the investigation, the fair trial.
