الحق في الوصول الى المعلومات في مجال البيئة بين التكريس التشريعي والانتفاع الفعلي

Résumé: تأكد جميع الصكوك الدولية أن الحق في الوصول الى المعلومات حق أساسي من حقوق الإنسان وجزء لا يتجزأ من الحق في حرية التعبير. وتعتبر حرية التعبير وحرية الوصول إلى المعلومات أداة لتعزيز الشفافية والتقليل من الفساد، واشراك المواطنين في عملية صنع القرارات المؤثرة على حياتهم وبيئتهم ، حيث أنه لا يمكن تفعيل مساهمة الأفراد في حماية البيئة إلا من خلال إضفاء الشفافية على أعمال السلطة وخاصة ما تعلق منها بالنشاط الإداري البيئي وضمان الحق في الإعلام والاطلاع على كل البيانات والمعلومات المتعلقة بوضعية البيئة بعيدا عن جو التعتيم والتهميش والإقصاء . وبالرغم من أن المشرع الجزائري نص على حق الأفراد في الوصول الى المعلومات إلا أنه لم يقدم ضمانات واضحة تكفل هذا الحق، أو إجراء عقابي على الجهات التي تحظر المعلومات أو تمنع تداولها. حيث أن الملاحظة التي تثار حول الإعلام البيئي في الجزائر هو النقص الفادح في المعلومات التي تقدمها الإدارة والسبب هو حبس الإدارة للمعلومات من جهة والعجز الحقيقي لدى الهيئات المركزية فيما يتعلق بالبيانات الموجهة للجمهور من جهة أخرى. All international instruments affirm that the right to access information is a fundamental human right and is an integral part of the right to freedom of expression. Freedom of expression and freedom of access to information are a tool to improve transparency and reduce corruption, and to involve citizens in the decision-making process affecting their lives and their environment, as the contribution of individuals to environmental protection can only be enabled by adding transparency to the activity of environmental management and guaranteeing the right to information and access to information. Although the Algerian legislator has stipulated the right of individuals to access information, it has not provided for clear guarantees to guarantee this right, or a punitive action against those who block information or prevent its circulation. As the observation that is raised about the environmental media in Algeria is the blatant lack of information provided by the administration, and the reason is the administration’s withholding of information on the one hand, and the real inability of the central bodies with regard to data directed to the public on the other hand.
