اختصاص سلطة ضبط البريد والإتصالات الإلكترونية بالفصل في النزاعات

Résumé: في ظل التطور الحاصل في قطاع الإتصالات الإلكترونية منح المشرع اختصاص الفصل في النزاعات لسلطة ضبط البريد والإتصالات الإلكترونية بموجب القانون رقم 18-04، نظرا لعدم فعالية القضاء وعدم التحكم الجيد للقضاة في المسائل ذات الصلة بقطاع الإتصالات بحكم طابعها التقني البحت، اضافة الى الخبرة والتخصص اللذين يتمتع بهما أعضاء هذه السلطة لفض هذا النوع من النزاعات، ويجد هذا الإختصاص معالمه في ضرورة وجود نزاع وارتباطه بفكرة النفاذ الى الشبكات. تتجلى خصوصية هذه الوظيفة في النزاعات التي تختص سلطة ضبط البريد والإتصالات الإلكترونية بالفصل فيها والتي تنشأ بين المتعاملين وبين المتعاملين والمشتركين في قطاع الإتصالات كما تبرز في الطبيعة القانونية لهذه الوظيفة والتي أثارت جدلا بين من إعتبرها ذات طبيعة قضائية ومن إعتبرها ذات طبيعة ادارية. Abstract: In light of the evolution taking place in the electronic communications sector the legislator has granted the jurisdiction to settle disputes to the Postal and Electronic Communications Regulation Authority under the Law No. 18-04, due to the ineffectiveness of the judiciary and the absence of good control of judges in matters related to the communications sector due to its purely technical nature, in addition to the experience and specialization that The members of this authority have to resolve this type of conflict, and this is presented in the necessity of having a conflict and its connection to the idea of access to networks. The feature of this work is reflected in the disputes that the authority of electronic communications is to resolve it, which might arise between dealers and between dealers and subscribers in the telecommunications section, and also emerge in the legal nature of this job, which has been a controversy between those who considered it as a judicial nature and an administrative nature.
