التحكيم لدى سلطة ضبط البريد والاتصالات الإلكترونية Arbitration At The Postal And Electronic Communications Control Authority

Résumé: تتمتع بعض السلطات الإدارية المستقلة الضابطة للنشاط الاقتصادي ضمن ما يعرف ب " الوظيفة شبه القضائية" بسلطة قمعية، وكذلك تسوية المنازعات في إطار التحكيم. والجدير بالذكر، أن المشرع الجزائري حدد هذه السلطات الممنوح لها الاختصاص التحكيمي على سبيل الحصر في المجال الاقتصادي وهي : سلطة ضبط البريد والاتصالات الالكترونية، ولجنة تنظيم عمليات البورصة ومراقبتها، ولجنة ضبط الكهرباء والغاز، وأخيرا سلطة ضبط الصفقات العمومية. وفي هذا السياق، يعتبر التحكيم إحدى وسائل تسوية المنازعات لدى سلطة ضبط البريد والاتصالات الالكترونية بموجب قانون البريد والمواصلات الإلكترونية لسنة 2018 ونصوص أخرى، إذ تعتبر هذه السلطة سباقة في تفعيل التحكيم لتسوية المنازعات بين متعاملي القطاع والجمهور. Some independent administrative authorities controlling economic activity within the so-called “quasi-judicial function” have repressive power, as well as the settlement of disputes in the framework of arbitration. It is worth noting that the Algerian legislator specified these powers granted to arbitral jurisdiction exclusively in the economic field: the authority to control postal and electronic communications, the commission for the regulation and control of stock exchange operations, the commission for the control of electricity and gas, and finally the authority to control public transactions. In this context, arbitration is one of the means of settling disputes with the Postal and Electronic Communications Control Authority under the Postal and Electronic Communications Law of 2018 and other texts, as this authority is considered proactive in activating arbitration to settle disputes between sector customers and the public.
