الدور التشريعي للسلطة التنفيذية في ظل التعديل الدستوري لسنة2016

Résumé: يهدف هذا المقال إلى إبراز الدور التشريعي للسلطة التنفيذية في الجزائر، كأحد أهم التحولات التي طرأت على إيديولوجية التوزيع الوظيفي في النظام السياسي،مما جعل من رئيس الجمهورية المحرك الأول للعملية التشريعية لحضوره الفعال في قلب العمل التشريعي،في حين تراجع دور ومكانة البرلمان إلى حد بعيد،هذه التطورات واكبتها الدساتير الجزائرية إلى غاية التعديل الدستوري 2016،الذي أبقى على اختصاصات رئيس الجمهورية التشريعية التي يمارسها مع الحكومة بواسطة ما يمتلكانه من تقنيات دستورية،لنصل إلى نتيجة هامة أنه لا يمكننا أن نقر أبدا بوجود ديمقراطية حقيقية دون إصلاح هذا الخلل الدستوري عن طريق تعديل الدستور بإعطاء البرلمان سلطات حقيقية. : Abstract This article aims to highlight the legislative role of the executive branch in Algeria, as one of the most important transformations that have occurred in the ideology of job distribution in the political system, which made the President of the Republic the first driver of the legislative process for his effective presence at the heart of the legislative work, while the role and status of Parliament have largely declined These developments were accompanied by the Algerian constitutions until the 2016 constitutional amendment, which kept the prerogatives of the president of the legislative republic that he exercised with the government, to reach an important result that we cannot acknowledge the existence of real democracy without fixing this constitutional imbalance by amending the constitution.
