Résumé: ملخص : ان الحكم عن تمام او قصور النظام القضائي العسكري في تحقيق المحاكمة العادلة يرتبط اساسا بالتوجهات الحديثة التى يسعى المشرع لتحقيقها في مختلف التعديلات التى تمس الجانب الاجرائي والموضوعي لنصوص القانونية في جانبها الجزائي , وانطلاقا من مدى تطابق نصوص قانون القضاء العسكري الجديد مع قانون الاجراءات الجزائية الذي يواكب التعديلات الدولية من مواثيق وقوانين تهدف الى تحقيق محاكمة عادلة لمن يشملهم القانون العسكري بدأ من مرحلة الاشتباه الى الاتهام الى المحاكمة والتى ترتبط بالمعايير المتعلقة بحماية الحقوق والحريات لأفراد الماثلين امام الجهات القضائية العسكرية سواء كانوا عسكريين او مدنيين .للتحقيق الاسمى للعدالة الكلمات المفتاحيه : -- القضاء العسكري – الشرعية الاجرائية – المحاكمة العادلة – حقوق الانسان - العقوبة – المتهم – الجناية – الخيانة – امن الدولة – جرائم عسكرية Résumé : Le système de justice militaire complet ou inadéquat est principalement lié à l’approche moderne recherchée par le législateur dans divers amendements touchant les aspects procéduraux et substantiels des dispositions juridiques sur son aspect pénal.
