Résumé: أغفل المشرع الجزائري تنظيم أحكام زواج وطلاق المحجور عليهم لجنون أو عته أو سفه أو غفلة، كما لم يبين المشرع حكم طلاق المحجور عليهم من حيث صحة وقوعه منهم، ولم يبين كذلك صلاحية النائب الشرعي في هذه المسائل ما يحيلنا إلى أحكام الشريعة الإسلامية طبقا للمادة 222 من قانون الأسرة. Abstract: The Algerian legislator omitted organizing the provisions of marriage and divorce of the interdicted person for insanity, mind infirmity, simple-mindedness, or the provisions of their divorce in terms of validity, or the powers of the legal representative in these matters. This leads to the provisions of Sharia provided in article 222 of the Family Law.
