Résumé: Agricultural real restate of the most important wealth ; and the most important assets on which the economy of any country is based because of its economic social and even political importance . The importance of the directive has emphasized the guidance of real estate .The offense of infringement does not deviate from the from the general framework of the offense of infringement of the property provided for in article 386 of the Penal Code which did not distinguish between whether the property was intended for urban or industrial construction or was intended for agriculture and whether the ownership of the property was national or private or was a possession only. The scholars of Islam have defined the crime of encroachment on the property as the term "raping". The shariah has denied it to the texts of the Qur'aan and Sunnah and to the consensus of Muslim scholars.
