سياسة التجريم و العقاب في مواجهة شغب الجماهير-دراسة في قانون رقم 13-05

Résumé: انتهج المشرع الجزائري في القانون رقم 13-05 المتعلق بتنظيم الأنشطة البدنية والرياضية و تطويرها، الساري المفعول، سياسة تجريم و عقاب متميزة عن تلك التي عهدناها في مواجهة جرائم القانون العام، كأحد التدابير للحفاظ على أمن وسلامة الأشخاص في المنشآت الرياضية من شغب الجماهير، بحيث قام بتوسيع دائرة تجريم أعمال العنف مقارنة بما نص عليها القانونين السابقين الملغيين، و جرم وقائيا أعمالا قد تؤدي إلى الشغب، أما العقوبات، فشددها مقارنة مع مثيلاتها بالقانون العام و في القانونين السابقين الملغيين، واستحدث ظرف تشديد يتعلق بإخفاء الفاعل لكل أو جزء من وجهه أثناء القيام بأعمال الشغب، و عقوبة تكميلية خاصة تتمثل في المنع من الدخول إلى المنشآت الرياضية، و حمّل النادي المسؤولية التأديبية عن شغب مشجعيه. Abstract: The Algerian legislator adopted In the valid Law n°13-05, related to the organization and development of physical and sports activities, a policy of criminalization and punishment, distinct from that which we are familiar with, in front of common law crimes, as one of the measures to maintain the security and safety of people in sports facilities from mass riots, so that he expanded criminalization circle of violence compared to what was stipulated in the previous two canceled laws, and criminalized as a precaution acts that may leads to riots, and about the penalties, he toughened the punishment of some acts compared to its counterparts in the common law; and in the previous two cancelled laws, and he introduced an aggravating circumstance related to the perpetrator’s concealment of all or part of his face, while rioting, as he introduced a special complementary penalty to prevent entry to sports facilities, and hold the club disciplinary responsibility for the rioting of its supporters.
