الإجهاض بين التجريم والإباحة في التشريع الجزائري والفرنسي

Résumé: يعتبر موضوع الإجهاض من أكثر المواضيع المثيرة للجدل، وهذا لتعلقه بمدى وحماية الجنين وحقه في الحياة والبقاء، ولقد تنازعت بشأن هذا الموضوع العديد من القوانين، فمنها من تعتبره خروجا عن القيم الإنسانية والأخلاقية والدينية، ومن ثم تجرمه، في حين هناك من لا تعترف بحماية الجنين، بل تعتبره جزءا من كيان أمه، وبالتالي فإن إنهاء حياته لا يعد جريمة. من هنا جاءت هذه الورقة البحثية كمحاولة لمعرفة موقف القانون الجزائري والقانون الفرنسي من مسألة الإجهاض، وقد توصلنا من خلال هذه الدراسة توصلنا إلى وجود اختلافات بين القانونين، فبينما جرم المشرع الجزائري فعل الإجهاض كمبدأ عام، مع إباحته للضرورة، يعتبر المشرع الفرنسي الإجهاض حق وخيار للمرأة، بعدما كان يعتبره جريمة سلط عليها أقصى العقوبات. The issue of abortion is one of the most controversial topics, and this is related to the extent and protection of the fetus and its right to life and survival, and many laws have disputed this topic, some of which consider it a departure from human, moral and religious values, and then criminalize it, while there are those who do not recognize the protection of the fetus, but consider it part of its mother's entity, and therefore ending its life is not a crime. Hence, this research paper came as an attempt to know the position of Algerian law and French law on the issue of abortion, and we have reached through this study that we found differences between the two laws, while the Algerian legislator criminalized the act of abortion as a general principle, while permitting the necessity, the French legislator considers abortion a right and an option for women, after he considered it a crime imposed on her the maximum penalties.
