طبيعة التعويض في مجال المسؤولية الإدارية

Résumé: الملخص: نظرا لتمتع الدولة وأجهزتها المختلفة بامتيازات السلطة العامة، مما يكفل لها حق تنفيذ قراراتها وأوامرها، وكذا إدارة مرافقها بالطرق المباشرة دون ما الحاجة إلى سند تنفيذي من القضاء، فإن من شأن ذلك أن يكون له تأثير واسع ومباشر في حياة الأفراد، مما قد يسهل النيل من حقوق وحريات الأفراد، وبالنتيجة إلحاق الضرر بهم. وهو ما يرتب للشخص المضرور طبقا لمبدأ المسؤولية الإدارية الحق في التعويض سواء كانت الأضرار اللاحقة به قد نتجت عن عمل إداري مشروع، أو غير مشروع، ذلك أن أساس المسؤولية قد يكون الخطأ، وقد تقوم هذه المسؤولية بدون خطأ. ونظرا لخصوصية الإدارة كطرف في النزاع، فقد حدد القانون طرقا خاصة للتعويض في مجال مسؤولية الإدارة العامة تختلف باختلاف الظروف المحيطة بوقوع الضرر، ومدى إمكانية الحكم بنوع من التعويض على حساب نوع آخر، في هذا السياق جاءت هذه الدراسة. الكلمات المفتاحية: المسؤولية الإدارية، التعويض، نوع التعويض.
