صيانة العين المؤجرة على ضوء القانون رقم 07-05 المعدل والمتمم للقانون المدني

Résumé: ملخص: إذا كان تسليم العين المؤجرة إلى المستأجر هو أحد أهم الالتزامات التي يتحملها المؤجر، فإن تحقيق الهدف المقصود من الإيجار يقتضي أن يتبع ذلك بالتزام اخر لا يقل أهمية هو تعهد العين بالصيانة. ولقد نظم المشرع أحكام هذا الالتزام بموجب القانون رقم 07-05 المعدل والمتمم للقانون المدني، إذ لم يغفل عن تناول الترميمات الضرورية التي تتطلبها صيانة العين المؤجرة والأعباء التي يتحملها المؤجر في سبيل ذلك، وكذلك الشأن بالنسبة للجزاءات المترتبة عن الإخلال بهذا الالتزام، كما تعرض إلى جواز قيام المستأجر بتنفيذ الترميمات المستعجلة، ومن جهة أخرى تناول مختلف الجزاءات التي تترتب على عاتق المؤجر بسبب الهلاك الكلي أو الجزئي للعين المؤجرة أثناء مدة الإيجار، فضلا عن بيان حق المؤجر في إجراء الترميمات المستعجلة الضرورية لحفظ العين المؤجرة، والجزاءات التي يتعرض لها إذا ترتب على إجراء هذه الترميمات إخلال كلي أو جزئي بالعين. كلمات مفتاحية: الإيجار، صيانة العين المؤجرة، الترميمات Abstract: If the delivery of the leased property to the lessee is one of the most important obligations which the lessor bears for this end, achieving the intended rent goal should be followed by another obligation of no lesser importance residing in the restoration promise. But the legislator’s system has subdued this obligation to the bille n° 05-07, modified and completed of the civil code. If he does not carry out the necessary restorations required by the rented property and the obligations which will consequently lies upon the lessor and so is for the penalties for the breach of these obligations as well as for the lessee to carry out urgent restorations and, on the other hand, deal with different penalties which will be borne by the lessor due to the total or partial damage of the rented property during the renting period as well as the statement of his right to carry out the urgent necessary restorations for the preservation of the rented property and the penalties which he will expose him to evacuate it.
