خصوصية السياسة العقابية في مكافحة ظاهرة الفساد المالي في التشريع الجزائري: The Specificity Of The Punitive Policy In Combating The Phenomenon Of Financial Corruption In Algerian Legislation:

Résumé: ترتكز سياسة الجزاء في القانون الجنائي بصفة عامة وقانون الفساد بصفة خاصة، على إعتباره رد فعل إجتماعي تتكفل السلطة العامة بتوقيعه ضد كل مرتكب لجريمة من جرائم الفساد، وبطبيعة الحال جرائم الفساد المالي كذلك، وقد أقر الإعلان العالمي لحقوق الإنسان جملة من المبادئ الأساسية وجب مراعاتها في هذه الجزاءات، ومن ثم نتطرق إلى الظروف والأعذار المعفية والمخففة والمشددة للعقوبة في جرائم الفساد، وتطبيقا لإهم مبدأ في القانون الجنائي ألا وهو مبدأ الشرعية فلا جريمة ولا عقوبة أو تدبير بغير نص، حيث ذهب المشرع الجزائري من خلال القانون رقم 06-01 إلى تجنيح كل جرائم الفساد مع تشديد الجزاءات المالية كما نص على أحكام خاصة في الإعفاء من العقوبات وتخفيفها وكذا في تقادم العقوبات، سوف نتطرق من خلال هذه الدراسة إلى بيان العقوبات المقررة لجرائم الفساد والمبادئ العقابية التي انتهجها المشرع في سياسة العقاب لمكافحة الفساد. The penalty policy in the criminal law in general and the law on corruption in particular, is based on considering it a social reaction that the public authority undertakes to sign against each perpetrator of a corruption crime, and of course financial corruption crimes as well. The Universal Declaration of Human Rights has approved a number of basic principles that must be observed in These penalties, and then we address the exempting, mitigating and aggravating circumstances and excuses for the punishment in corruption crimes, and in application of the most important principle in criminal law, which is the principle of legality. Corruption crimes with the intensification of financial penalties as it stipulated special provisions in the exemption and mitigation of penalties as well as in the prescription of penalties, we will address through this study the statement of penalties for corruption offenses and the punitive principles pursued by the legislator in the policy of punishment to combat corruption.
