الطبيعة القانونية للمرصد الوطني للوقاية من التمييز وخطاب الكراهية The Legal Nature Of The National Observatory For The Prevention Of Discrimination And Hate Speech

Résumé: نظرا لانتشار ظاهرة التمييز وخطاب الكراهية في المجتمع الجزائري، سارعت السلطات المختصة إلى إصدار القانون رقم 20-05 المتعلق بالوقاية من التمييز وخطاب الكراهية ومكافحتهما، إذ يتضمن القانون جانبين، الجانب الوقائي والجانب العلاجي، كما تضمن الجانب الوقائي النص على المرصد الوطني للوقاية من التمييز وخطاب الكراهية كألية وقائية. لم يكيف المشرع الجزائري المرصد الوطني، غير أنه بالاعتماد على المعايير الفقهية والقضائية التي يتم على ضوئها تكييف السلطات الإدارية المستقلة والمتمثلة في الطابع السلطوي، الطابع الإداري وطابع الاستقلالية، يمكن القول بأن المرصد الوطني سلطة إدارية مستقلة في مجال حقوق الانسان و أخلقة الحياة العامة، وذلك بالنظر لوجود العديد من مقومات السلطة الإدارية المستقلة في المرصد. Given the widespread phenomenon of discrimination and hate speech in Algerian society, the competent authorities rushed to promulgate Law No. 20-05 related to preventing and combating discrimination and hate speech, as the law includes two aspects, the preventive aspect and the remedial aspect. Hate as a protective mechanism. The Algerian legislature has not adapted the National Observatory. However, by relying on the jurisprudential and judicial standards in the light of which the independent administrative authorities are adapted and represented in the authoritarian character, the administrative character and the character of independence, it can be said that the National Observatory is an independent administrative authority in the field of human rights and the ethics of public life. Given the presence of many components of independent administrative authority in the observatory.
