ظاهرة الإفلات من العقاب في مسارات العدالة الإنتقالبة

Résumé: يشكل الإفلات من العقاب هاجس العدالة الدولية الجنائية ؛ فهو يمنح للمجرمين فرصة غير مستحقة للتنصل من مسؤوليتهم مما يشجعهم على المزيد من الانتهاكات، كما أنه في ذات الوقت يحرم الضحايا و أقاربهم من الحق في إقرار العدالة فيطيل أمد الأذى الجرمي الأصلي ويؤجل الإنصاف الفعال، وهو ما يفسر كثافة النصوص الجنائية الدولية في مجال التصدي لظاهرة الإفلات من العقاب وصرامة آلياتها. وتأتي هذه الورقة البحثية إلى لَفْتِ الانتباه إلى "العدالة الانتقالية" باعتبارها آلية تلجأ إليها المجتمعات المضطربة والباحثة عن الاستقرار، وكذا توضيحِ مخاطر استغلال روح التسامح والتصالح التي ترتكز عليها هذه الآلية، والعمل على توظيفها لتكريس سياسة الإفلات من العقاب، وقد تم تدعيم جدية هذا الطرح باستحضار نماذج دولية شكلت فيها العدالة الانتقالية تحديا قلّلَ من جدوى جهود مكافحة الإفلات لاسيما في كل من جنوب إفريقيا والأرجنتين. By recalling international models in which transitional justice represented a challenge that reduced the effectiveness of efforts to combat impunity, especially in South Africa and Argentin.
