الطعن بالمعارضة و الاستئناف في أحكام محكمة الجنايات Opposition And Appeal To Criminal Court Judgments

Résumé: تتسابق التشريعات الجزائية حاليا في تطبيق مبدأ التقاضي على درجتين في الجنايات على غرار الجنح و المخالفات امتثالا لالتزاماتها الدولية عبر المواثيق الدولية من خلال الإعلان العالمي لحقوق الإنسان لسنة 1948، و الذي انضمت إليه الجزائر بتاريخ 10 سبتمبر 1963، و العهد الدولي للحقوق المدنية و السياسية الصادر عن الأمم المتحدة سنة 1966، و الذي انضمت إليه الجزائر أيضا بتاريخ 16 ماي 1989. و في هذا الإطار أقر المشرع الجزائري الطعن بالمعارضة و الاستئناف في أحكام محكمة الجنايات على إثر إنشائه لمحكمة جنايات استئنافية، بعد تعديل قانون الإجراءات الجزائية، بموجب القانون 17-07 المؤرخ في 27 مارس 2017، تكريسا لمبدأ التقاضي على درجتين، بعد إعلان المشرع الدستوري عن وجوب ضمان التقاضي على درجتين للمتهم في المواد الجزائية. Abstract: Criminal legislations are currently in the process of applying the principle of litigation to two degrees in crimes such as misdemeanors and infractions, in compliance with their international obligations, through the Universal Declaration of Human Rights of 1948, which Algeria acceded on 10 September 1963, and the International Covenant on Civil and Political Rights of the United Nations in 1966, which Algeria also joined on 16 May 1989. In this context the Algerian legislator has approved the opposition and appeal in the judgments of the criminal Court, following its establishment of an appeals court, after the amendment of the Code of Criminal Procedure, under Law 17-07 of 27 March 2017, consecrating the principle of litigation on two levels, after the announcement by the constitutional legislator that two-degree litigation should be ensured for the accused in the penal matters.
