جرائم الإساءة لذوي الإحتياجات الخاصة - دراسة في ظل التشريع الجزائري وبعض القوانين العربية -

Résumé: تهدف هذه الدراسة إلى تسليط الضوء على موضوع الإساءة إلى فئة ذوي الإحتياجات الخاصة، فنظرا لخصوصية هذه الفئة مقارنة بالأشخاص العاديين في المجتمع، فإنهم كثيرا ما يتعرضون لبعض الإساءات والمضايقات التي لا تقدر وضعهم وظروفهم النفسية الهشة، وذلك من خلال التنمر والإساءة المعنوية واللفظية عبر السخرية منهم، ومحاولة جعل هذه الفئة مادة للتسلية، خاصة من طرف فئة الشباب المراهقين، مستغلين الفراغ القانوني في هذا الشأن، باعتبار أن بعض التشريعات لا توفر حماية خاصة بالمفهوم الدقيق لفئة ذوي الإحتياجات الخاصة فيما يتعلق بالإساءة التي لا تنطوي على عنف جسدي. ويعتبر المشرع الجزائري والكثير من التشريعات العربية من بين الدول التي تضمنت قوانينها -سواء بشكل مباشر أو غير مباشر- بعض النصوص والمواد القانونية التي تجرم أفعالا من شأنها الإساءة لذوي الإحتياجات الخاصة. Abstract: This study aims to highlight the issue of abuse of the group of persons with special needs, given the specificity of this group compared to ordinary people in society, they are often subjected to some abuse and harassment that do not appreciate their fragile situation and psychological conditions, especially by the group of young adolescents, who take advantage of the legal vacuum in this regard, because some legislation does not provide special protection only for people with special needs with regard to abuse that does not involve violence. physical. Algeria and many Arab countries are among the countries whose laws include, either directly or indirectly, some legal texts and materials that criminalize acts that would offend people with special needs.
