دور السلطة العليا للشفافية والوقاية من الفساد ومكافحته في مكافحة مظاهر الإثراء غير المشروع The Role Of The Higher Authority Of Transparency And Preventing And Combating Corruption

Résumé: تهدف هذه الورقة البحثية لتحقيق تحليل قانوني لمختلف الأساليب القانونية المستحدثة بموجب القانون 22-08 المتعلق بتنظيم السلطة العليا للشفافية للوقاية من الفساد ومكافحته، والتي أقرها المشرع من أجل مواجهة مظاهر الإثراء غير المشروع، للوقوف على ماهية الدور الرقابي المنوط بالسلطة في مكافحة مظاهر الإثراء غير المشروع ومدى فاعليته في الكشف عن جريمة الإثراء غير المشروع. وقد خلصت هذه الدراسة إلى أن الدور الذي أنيط بالسلطة العليا للشفافية والوقاية من الفساد ومكافحته، يتسم بالوضوح والفاعلية وذلك بفضل الأساليب التي مُكنت منها السلطة بموجب القانون 22-08 المتعلق بتنظيمها وتشكيلتها وصلاحياتها، رغم بعض النقائص. This research paper aims to achieve legal analysis of the different new legal mechanisms by law 08-22 which works on organising the higher authority of transparency and preventing and combating corruption, that were set by the legislator to address the manifestations of illicit enrichment, to see what is the oversight role of the authority to combat the illicit enrichment and its efficiency in detecting illicit enrichment crime. This study has concluded that the role of the higher authority of transparency and prevention and combating corruption is characterised by clarity and transparency due to the mechanisms that the authority took advantage of by law 08-22 that works the organisation, composition and jurisdiction of the authority despite the shortcomings.
