خصوصية دور السلطة العليا للشفافية والوقاية من الفساد ومكافحته في محاربة الفساد من منظور القانون رقم 22-08

Résumé: تنفيذا للاستراتيجية الوطنية لمكافحة الفساد، استحدث المشرع الدستوري لسنة 2020 مؤسسة دستورية تسمى السلطة العليا للشفافية والوقاية من الفساد ومكافحته، تم تصنيفها ضمن المؤسسات الرقابية، ولقد صدر القانون 22-08 المؤرخ في 14 ماي 2022 لتنظيم عمل هذه السلطة. وتميز هذا القانون بخصوصيته ولعل أهم ما جاء به توسيع تشكيلة مجلس السلطة العليا وتعدد هيئاتها وتزويدها بصلاحيات واسعة في مجال الوقاية من الفساد ومكافحته، فإضافة إلى دورها الوقائي التوجيهي تختص السلطة العليا في مجال دورها الرقابي بإخطار الجهات القضائية بجرائم الفساد، كما تختص بإجراء التحريات الإدارية والمالية عن مظاهر الإثراء غير المشروع وغيرها من الصلاحيات. Pursuant to the National Anti-Corruption Strategy, the Constitutional Legislator has established for the year 2020 a constitutional institution called the Supreme Authority for Transparency, Prevention and Fight against Corruption, which is classified as a control institution; whereas the law 08-22 was issued on the 14th May, 2022 in order to regulate the Authority's work. This law is characterized by its specificity, perhaps the most important of which is the expansion of the composition of the Supreme Authority and the multiplicity of its bodies and providing them with broad powers in the prevention and control of corruption. In addition to its preventive and directive role, the supreme authority is competent in the field of its oversight role in notifying the judicial authorities of corruption crimes. It is also competent to conduct administrative and financial inquiries into manifestations of illicit enrichment and other powers.
