المسؤولية التقصرية المتعلقة بالذكاء الإصطناعي

Résumé: مما تم دراسته فيما يتعلق بالمسؤولية المدنية التقصيرية المترتبة عن الذكاء الاصطناعي، قد أضحت نظاما عاجزا عن إقامة قواعد مسؤولية عادلة وذلك لأن مختلف هذه القواعد وجدت لمواجهة أضرار المركبات التقليدية التي مهما بلغت تقنياتها فهي لن تسير بالمنطق البشري كما هو الحال في المركبات المستقلة ولذلك فإن هذه القواعد تهدر أي كيان أو اعتبار لخصوصية المركبة ذاتية القيادة التي تتمتع بالذكاء الاصطناعي. أما بالنسبة للأسس القانونية المستحدثة أي الاتجاهات الحديثة للمسؤولية فإننا نرى أن أسس المسؤولية الموضوعية قاصرة هي كذلك في مواجهة الأضرار الناتجة عن حوادث الذكاء الاصطناعي في حالات كثيرة، حيث تحمل الشركة المصنعة المسؤولية وتميل الكفة الصالح مالك السيارة حتى وإن كان له يد في إحداث الضرر من جهة في حالات عديدة، بينما تحمل المسؤولية لمالك السيارة وحده في حالات أخرى حتى وإن كان سبب الضرر عطب في برمجيات المركبة من جهة أخرى. Abstarct : Fromwhat has been studiedwith regard to civil tort liabilityresultingfromartificial intelligence, it has become a system thatisunable to establishfairliabilityrules, becausethesevariousrulesexist to counter the damages of conventionalvehicles, which, no matter how technical, will not followhumanlogic as is the case in autonomousvehicles, and thereforetheseruleswasteanyentity or consideration for the privacy of the self-drivingvehiclethatenjoysartificial intelligence. As for the new legal bases, i.e. the recent trends of liability, webelievethat the foundations of strict liability are alsodeficient in the face of damages resultingfromartificial intelligence accidents in many cases, where the manufacturer holds the responsibility and tilts the favor of the car ownereven if he has a hand in causing the damage on the one hand in many cases, while the responsibilityis borne by the owner of the car alone in other cases, even if the cause of the damage is a defect in the vehicle's software on the other hand.
