إعفاء الناقل البري للأشخاص من المسؤولية على ضوء القانون الجزائري

Résumé: ملخص: لا شك أن مسؤولية الناقل البري للأشخاص هي مسؤولية عقدية ناشئة عن عقد النقل، ويسأل الناقل عن كل ضرر يتسبب فيه هو أو أحد تابعيه في حالة ما إذا أخل بالتزامه بضمان سلامة المسافر أثناء فترة النقل، أو لم يوصله في الوقت المحدد في عقد النقل، و لكن مسؤولية الناقل البري للأشخاص كما أن لها بداية فإن لها نهاية أيضا، إذ يمكن أن تنقضي بالطريق الطبيعي و هو التعويض عن الضرر أو برضا المضرور بما قدمه الناقل من تعويض أيا كان، و قد تنقضي بطريق استثنائي، إذ لا يعقل أن يظل الناقل مسؤولا لا محالة في كل الأحوال، و هو ملزم بالتعويض قطعا، و ذلك بنص المشرع الجزائري على حالات تمهد له أن يدفع المسؤولية عن نفسه بالرغم من تحقق ضرر للمسافر، و هو ما نتناوله بالتوضيح في هذه الورقة. Abstract: There is no doubt that the responsibility of the personal land carrier is a contractual liability arising from the contract of carriage, and the carrier shall be liable for all damage caused by him or one of his subordinates in the event that he breaches his obligation to ensure the safety of the passenger during the transport period, or does not deliver him within the time specified in the transport contract, and But the responsibility of the land carrier of people, just as it has a beginning, has an end as well, as it may lapse by the natural way, which is compensation for the damage or with the consent of the injured with the compensation provided by the carrier of whatever compensation, and it may lapse in an exceptional way, as it is unreasonable for the carrier to remain responsible. Absolutely impossible in all cases, and he is definitely obligated to compensate, and that is according to the Algerian legislator's text of cases that pave him to pay responsibility for himself despite the harm to the traveler, and this is what we discuss with clarification in this paper.
