إشكالية تطبيق نظام التقاعد في الجزائر بين التشريع والتنظيم

Résumé: لقد عرفت الجزائر كغيرها من الدول نظام التقاعد باعتباره مظهرا من مظاهر التأمين الاجتماعي، والذي يقوم من خلاله العامل ورب العمل بدفع اشتراكات التأمين الاجتماعي كي يستفيد مستقبلا من تعويض أو معاش عند بلوغه السن القانوني لإنهاء علاقة العمل، لكن هذه العلاقة تخضع لأحكام قانون التقاعد والذي طرأت عليه العديد من التعديلات بسبب التغيرات الاقتصادية.إلا أن الإشكال في تطبيق القانون الحالي هو تأخر إصدار النص التطبيقي للتقاعد في المهن جد شاقة وهو ما يخالف مبدأ الأمن القانوني، الذي يتطلب التوافق بين النص التشريعي والتنظيمي واستقرار المراكز القانونية. Like other countries, Algeria has experienced the pension system as an aspect of social insurance, whereby the worker and the employer pay social insurance contributions to receive future benefits or pensions after reaching the legal age to terminate the employment relationship. However, this relationship is subject to the provisions of the pension law, which has undergone many changes because of the economic changes. However, the problem of applying current law is the late issuance of regulation governing of the pension in the difficult occupation and this is contradiction with the principle of legal security. That which necessitates conformity between legal texts and stability in legal centers.
