الضوابط القانونية للجزاء الجنائي في ضوء مستجدات التشريع الجزائري Controls For Criminal Penalties In Light Of Developments In Algerian Legislation

Résumé: ملخــــــــــــــص يعتبر الجزاء الجنائي ذلك الأثر الذي يترتب قانونا على سلوك يعد جريمة، وإعماله هو النتيجة القانونية المترتبة على مخالفة نصوص التجريم الواردة في قانون العقوبات أو غيره من القوانين المكملة، والإشكال الذي تطرحه الدراسة يتمحور حول مفهوم الجزاء الجنائي وإلى أي مدى تتحدد ضوابطه في التشريع الجزائري، فالجزاء الجنائي هو رد الفعل الاجتماعي الذي يوقعه المجتمع بواسطة سلطاته العامة على من اقترف الجريمة، ولتوقيع الجزاء على الجناة لابد من قيام المسؤولية الجنائية، وارتكاب الفعل المجرم، وانتفاء الموانع الإجرائية، ويتحدد مضمونه في كونه يترتب بنص القانون و يأمر به القضاء و تطبقه السلطات العامة و يتمثل في إهدار و إنقاص حقوق الشخص المحكوم عليه جنائيا بهدف وقاية المجتمع من الإجرام. الكلمات المفتاحية: الجزاء الجنائي؛ قانون العقوبات؛ الفعل المجرم. Summary Criminal punishment is considered to be the legal effect on the conduct of a crime, and its implementation is the legal result of violating the criminalization provisions of the Penal Code or other complementary laws. The form presented in the study revolves around the concept of criminal punishment and to what extent its controls are determined in Algerian legislation, Criminal punishment is the social reaction that the society signs with its public authorities against the perpetrator of the crime. To punish the perpetrators, the criminal responsibility, the commission of the criminal act and the absence of procedural impediments must be determined. It was ordered by the judiciary and applied by the public authorities and is to waste the person and sentenced him to lose the rights of a criminal in order to protect society from crime.
