دور المقاصد الشرعية في الترجيح زمن الأوبئة.

Résumé: ملخص: تبحث هذه الدراسة مسألة الترجيح بالمقاصد زمن الأوبئة، فمن المعلوم أن الوباء يفرض على الناس ظروفا معينة وأجواء خاصة، فتعن للناس مسائل ومستجدات لا عهد لهم بها قبل الوباء، فيحتاجوا معرفة حكم الشرع فيها؛ ولكن الأدلة الجزئية كثيرا مالا تسعف الفقيه، فيلجأ إلى إعمال المقاصد وتفعيلها؛ وتنزيلها والترجيح بينها أو بناء عليها، ومن هنا بيّنا في هذه الدراسة حقيقة المقاصد وماهيتها ومكانتها ودورها في صناعة الفتوى، مردفين ذلك ببيان ضوابط اعتبار المقصد وبناء الفتوى عليه ومجال هذا الاعتبار، لئلا تدعى المقصدية في أمور لم يقصدها الشارع، بل ربما تخالف قصده في بعض الأحيان كما نرى، فليونة هذا المصطلح سهلت التعلق به، فاتخذه البعض مطية لتحليل المحرم وتحريم المحلل، حسب ما تهوى النفوس وتشتهي. وحتى لا يطغى على البحث جانب التنظير والتجريد الذي كثيرا ما تعمي على المسائل، فيصعب على العقل فهمها وإدراكها، عززنا بمبحث تطبيقي لتنزيل الفكرة على واقع الناس وقضاياهم التي يعيشونها فتتلقفها الأذهان بيسر وتصل إلى كنهها وتعقل حقيقتها. Abstract: This study examines the issue of probability using purposes in the time of epidemics. It is well known that an epidemic imposes on people certain conditions that were not before . Indeed, People need to know the religious judgment (fatwa) on their daily life issues, and often partial evidence does not help the scholar, so he considers using purposes and building the fatwa on them. Therfore, the study comes to explain and clarify the crucial importance of purposes and its role in the process of fatwa . After that, the researcher defined the outlines and preconditions of the purposes and its role in building a fatwa;Because of the allegations that used to be made by some and their wrongful use of the purposes in order to legalize the prohibited and prohibit the legal. Consequently, the study was supported by a practical chapter in order to make it easier and clearer for the readers and researchers.
