الحماية القانونية للمواد الغذائية من الإشعاعات المؤينة في ضوء التشريع الجزائري

Résumé: تتناول هذه الورقة البحثية الحماية القانونية للمواد الغذائية من الإشعاعات المؤينة في ضوء التشريع الجزائري، هذا الأخير الذي أحاط هذه المواد بحماية خاصة من خلال المرسوم المتعلق بتأيين المواد الغذائية، وأشار المشرع لهذا النوع من الحماية من خلال القانون 83–03 المتعلق بحماية البيئة وذلك بنص المادة 103 منه، وبالرغم من ذلك, إلا أن صدور هذا القانون في إطار التنمية المستدامة استبعد كل ما له علاقة بالإشعاعات المؤينة، واستمر الحال على هو عليه في ظل فراغ تشريعي لمدة سنتين, إلى غاية صدور المرسوم الخاص بهذا المجال؛ وهو المرسوم 05–118 المتعلق بتأيين المواد الغذائية، دون نسيان الحماية المقرر لهذه المواد بصفة عامة في إطار المرسوم 05–117 المتعلق بتدابير الحماية من الإشعاعات المؤينة. Throughout thèse papers i intend to expose the legal protection of foodstuffs from ionizing radiation in the light of the Algerian legislation, this latter, took these materials to special protection by the decree related to ionize food, and legislator pointed for this type of protection through the law 83-03 related to the protection of the environment through legal article 103, is that when the enactment of law 03-10 related to the protection of the environment in the context of sustainable development, has ruled out everything related to ionizing radiation, and this, continued in the legislative vacuum during two years until the issuance of a special decree in this area, which is the decree 05-118 related to ionize food, such as the planned protection of these materials under the decree 05-117 concerning the protection measures against ionizing radiation.
