فعالية نظام التوثيق ودوره في تحقيق استقرار المعاملات العقارية

Résumé: يشكل نظام التوثيق أهم ضمانة لحفظ الحقوق وقطع المنازعات واستقرار المعاملات العقارية، لذلك فقد كان محل تنظيم من طرف القوانين الجزائرية التي عينت الأشخاص القائمين عليه وحددت تكوينهم والتزاماتهم و ازدادت الحاجة اليوم إلى ضمانات التوثيق نتيجة تشعب جوانب الحياة، حيث أصبح المتعاقد عاجزا عن استيفاء جملة هذه الإجراءات، مما كان لزاما معه الاستعانة بذوي الاختصاص في إبرام كثير من العقود للإلمام بمعطيات العملية التعاقدية المقدم عليها، لهذا فإن دور الموثق اليوم لا يقف عند حدود إضفاء الطابع الرسمي على العلاقة العقدية، و تقديم النصح و الإرشاد ، وبذلك حماية المعاملات العقارية من ظواهر الاستيلاء و التعدي The documentation system is the most important guarantee for preserving rights, cutting disputes and stabilizing real estate transactions Therefore, it was subject to regulation by the Algerian laws that appointed the persons responsible for it and defined their composition and obligations, and the need for documentation guarantees today has increased due to the bifurcation of aspects of life Where the contractor became unable to complete all these procedures Therefore, it was necessary for him to seek the assistance of specialists in concluding many contracts, in order to be aware of the data of the contractual process submitted to them Therefore, the role of the notary today does not stop at the limits of formalizing the contractual relationship, and providing advice and guidance, In this way, real estate transactions are protected from the phenomena of seizure and encroachment
