المسؤولية المدنية عن المخاطر الصحية للنفايات الطبية أو الاستشفائية

Résumé: يعتبر موضوع النفايات الطبية أو الاستشفائية و كذا المسؤولية القانونية عن مخاطرها وأضرارها من المواضيع ذات الأهمية في المنظومة الصحية، ذلك أن هذا النوع من النفايات قد يحدث آثاراً صحية ضارة لا تقتصر على المرضى أو العاملين في المجال الطبي بل تمتد خارج هذا النطاق في ظل التوسع في تقديم الرعاية الصحية خارج المنشآت الطبية كما في حالة الرعاية الصحية المنزلية أو الميدانية. بالإضافة إلى الأضرار البيئية الناتجة عن سوء تسييرها و التخلص منها. ومن هذا المنطلق يكون من الضروري وضع حدود للمسؤولية بين الجهات ذات الصلة بهذا النوع من النفايات سواء كانت منتجة لها، أو مكلفة بتسييرها والتخلص منها، بالإضافة إلى تكريس مسؤولية الدولة بشكل عام في إطار التزاماتها في مجال الصحة العامة. Abstract: One of the big and dangerous waste is the medical one which become a very important topic in the health system, also legal responsibility for its risks and damages that may cause adverse health effects not to the patients or medical personnel only but extend beyond that in light of the expansion of the provision of health care outside medical facilities as in the case of home health care or field. In addition to the environmental damage caused by poor management and disposal of which In this sense, it is necessary to develop limits for responsibility among bodies related to this type of waste, whether it is producing it, or is charged with managing it and disposed of, in addition to establishing the responsibility of the state in general within the framework of its public health obligations.
