دور العقود الإدارية في حماية البيئة في النظام القانوني الجزائري

Résumé: This thesis dealt with the subject of administrative contracts and their role in protecting the environment in the Algerian legal system, from legal environmental approach. Its dealt with the role of public procurement, as one of the most important administrative contracting means for state and its other public persons in protecting the environment. Moreover, the Algerian legislator has include obligatory the environmental dimension within all the stages of concluding public deals, which begin from the pre-contracting stage and end with the delivery of the public deal to the contracting dealers. On the other hand, the thesis tackled the concession contract, as one of the most important contracts of public utility delegation, especially the concession contracts for the management and exploitation of house wastes, and concession contracts related to cleaning services, and its consideration to environmental concern. تناولت الأطروحة موضوع العقود الإدارية ودورها في حماية البيئة في النظام القانوني الجزائري، من خلال مقاربة قانونية بيئية. حيث تناولت دور عقود الصفقات العمومية، باعتبارها أهم وسائل التعاقد الإداري للدولة وأشخاصها العمومية الأخرى في حماية البيئة، أين أدرج المشرع الجزائري وجوبا البعد البيئي في جميع مراحل إبرام الصفقات العمومية؛ بداية من مرحلة ما قبل التعاقد، وانتهاءا إلى تسليم الصفقة العمومية للمصلحة المتعاقدة. فيما تطرّقت من جهة أخرى إلى عقد الامتياز باعتباره أهم عقود تفويض المرفق العام، ولاسيما عقود امتياز تسيير واستغلال النفايات المنزلية، وعقود الامتياز المتعلقة بخدمات التطهير، و مدى مراعاتها لاعتبار حماية البيئة.
