الإطار القانوني لعمليات التلقيح الاصطناعي على ضوء قانون الصحة الجزائري 18-11
Résumé: مما لا شك فيه أن صدور قانون الصحة الجديد رقم 18-11 أدى إلى إعادة بعث النقاش حول النطاق القانوني لعمليات التلقيح الإصطناعي وهذا بالرغم من أن المشرع الجزائري إعترف بالتلقيـح الإصطناعـي كتقنيـة طبيـة مساعدة على الإنجاب في ظل صدور الأمر 05/02 المؤرخ في 27/02/2005 من خلال المادة 45 مكـرر من قانون الأسرة إلا أن مادة واحدة لم تكن كافية، لكن صدور القانون رقم 18-11 المتعلق بالصحة شكل لنا فعلا نظاما قانونيا لعليات التلقيح الاصطناعي و قيدها بجملة من الضوابط و الشروط خصوصا المواد من 370 إلى 376. Abstract: There is no doubt that the issuance of the new Health Law No 11-18 led to the resumption of the debate on the legal scope of IVF operations, and this despite the fact that the Algerian legislator recognized artificial insemination as a medical technology assisted to have children after the issuance of Ordinance 05/02 of 02/27 / 2005 through Article 45 bis of the Family Law but one article was not sufficient But the issuance of Law No. 18-11 has already established a legal system for artificial insemination, and set conditions for it, especially Articles 370 to 376.
