الإستصلاح عن طريق الإمتياز وفق المرسوم التنفيذي 21-432

Résumé: الملخص: أمام تناقص وعاء العقار الفلاحي اضطرت السلطة إلى تشجيع عمليات الاستصلاح، و التي شهدت ركود نسبي رغم التدابير التشجيعية المنصوص عليها في القانون 83/18 ،وكذلك المرسوم التنفيذي رقم97/483 المؤرخ في 15/12/1997 الذي يحدد كيفيات منح الامتياز في القطع الأرضية التابعة للأملاك الخاصة للدولة في المساحات الاستصلاحية و أعبائه و شروطه ، و بقصد انتعاش الاستصلاح صدر المرسوم 21/432 الذي يحدد شروط وكيفيات منح الأراضي التابعة للأملاك الخاصة للدولة، للاستصلاح في إطار الامتياز،و قد عرفت المادة الثانية الإستصلاح بكل عمل يرمي إلى وضع حيز الإنتاج وتثمين قدرات الأملاك العقارية ذات الوجهة الفلاحية للسماح بإنتاج سنوي أو متعدد السنوات الموجه للاستهلاك البشري أو الحيواني أو الصناعي مباشرة أو بعد تحويله. و يتبين من دراسة أحكام هذا المرسوم أن تشجيع الإستثمار يكون بمنح الأرض عن طريق عقد امتياز و بمقابل دفع أتاوة و تساهم الدولة بالنسبة للمشاريع التي تحظى بالأولوية بتوفير المياه و الطاقة الكهربائية و شق الطرق بالإضافة إلى الاستفادة من الامتيازات المالية و الجبائية. Abstract:: Near to the minority of the agricultural real estate, the government was obliged to encourage the land reclamation despite of the encouraging measures signing in the law 83/18 and the executive decree number 97/483 dated in 15/12/1997 which says how to let the opportunity to franchise in the use of government plots in the reclamation areas both rules and burdens,to let the reclamation develop , degree was essued 21/432 which specifies the rules to give the government plots reclamation in the area of franchise,the second rule of reclamation for each work to pose the output and valuate the capacities of the agricultural real estate to produce per year or several years to be consumed by people,animals or industries direct or after treating. The study of the rules decree that encourage the investment be with giving the area by franchise contract despite of a royalty payment however the government will share in the project that has the priority to supply water , electricity, transform roads and also benifit from financial and fiscal privileges
