التصرف في الأعضاء البشرية بين الأحياء على ضوء أحكام الاجتهاد الفقهي المعاصر

Résumé: يعتبر موضوع التصرف في الأعضاء البشرية بين الأحياء من الموضوعات الطبية الهامة الحادثة، والتي شغلت العديد من المجامع الفقهية ومجالس الفتوى وجهاته في العالم الإسلامي، والواقع أن هذه القضية من الأهمية بمكان بعد أن أبرز التقدم الطبي الحاجة الماسة إليها، وضرورة بلورة النظر الفقهي فيها؛ بل ومتابعة ما يستجد فيها من صور جزئية وملابسات وتفصيلات دقيقة.. فقد كان الأمر في إطار محدود يتعلق بالاستفادة من بعض الأعضاء. وقد تصدت المجامع الفقهية الإسلامية لدراسة هذا الموضوع، وبيان حكم الشريعة الإسلامية فيه، وتمثل هذه الدراسات خطوات جادة في هذا المجال لها وزنها العلمي، نظرا لما تتمتع به المجامع الفقهية من مكانة وصفات على مستوى العالم الإسلامي تجعلها تقدم صورة من أفضل صور الاجتهاد الجماعي المعاصر في التصرف في الأعضاء البشرية بين الأحياء والمشكلات المستجدة فيها. Abstract: The subject of the disposal of human organs among the living is one of the important medical topics that occurred, which occupied many doctrinal universities and advisory councils and it's destinations in the Islamic world, and in fact this issue is important after the medical progress highlighted the urgent need for it, and the need to crystallize the consideration it is a follow-up to the new partial images, circumstances and precise details, it was in a limited context to take advantage of some members . The Islamic jurisprudentiel universities have addressed the study of this subject and the statement of the rule of Islamic law in it, and these studies represent serious steps in this field that have scientific weight, given the status of the doctrinal universities and recipes in the Islamic word that make them present one of the best images of ijtihad contemporary collective in the behavior of human organs between the living and the problems that arise in them .
