Résumé: صفة الحياة ليست مرتبطة بمرحلة من مراحل تطور الكائن الحي دون أخرى, فالخلية الواحدة المنفصلة تتصف بهذه الصفة كما تتصف بها مجموعة من الأنسجة المشكلة للعضو, والكائن الحي مكتمل الأعضاء. وكما يقابل ذلك حالة الموت التي لا يحكم بها عند الإنسان إلا تحققت فيها المعايير وآخرها موت خلايا الدماغ وأخذت في التحلل. تعد مصلحة حفظ النفس من المقاصد الضرورية التي جاءت بها الشريعة الإسلامية, حيث شملتها بأحكام تضمن لها البقاء والاستمرار, ومنها أحكام العلاج والتداوي, التي تعتبر من الوسائل الحافظة للنفس من الفناء. ومع تطور العلم توصل الإنسان إلى هذه الوسائل والتي منها زراعة ونقل الأعضاء البشرية مابين الأحياء, أومن الأموات إلى الأحياء, فهي إذن عملية هامة وفي نفس الوقت خطيرة والواجب على المختصين في العلوم الشرعية والطبية ورجال القانون, أن يزنوا هذه القضية بميزان الشرع, ويضعون لها حدودا وضوابط لا يمكن تجاوزها لأن الأمر يتعلق بكرامة الإنسان. الكلمات المفتاحية : التصرف في جسم الآدمي,الاتجار بالأعضاء البشرية,التبرع بالأعضاء البشرية,زراعة الأعضاء البشرية,التلقيح الاصطناعي,إجهاض الأجنة. Note summary: The quality of life is not related to one stage of the development of the organism without the other, so one separate cell has this characteristic as it is characterized by a group of tissues forming the organ, and the organism is complete organism. And as this corresponds to the state of death that is not judged by a person unless the standards are met, the last of which is the death of brain cells and began to decompose. The interest of self-preservation is one of the necessary purposes that the Islamic Sharia has brought about, as it includes provisions that guarantee its survival and continuity, including the provisions of treatment and medication, which are considered one of the means that protect the soul from annihilation. With the development of science, man came to these means, including the cultivation and transfer of human organs from among the living, or from the dead to the living, so it is an important and at the same time dangerous process. And controls that cannot be crossed because it is a matter of human dignity.
