حماية المستهلك في مجال المعاملات الالكترونية بالجزائر على ضوء القانون 18-05 المتعلق بالتجارة الالكترونية

Résumé: نتناول من خلال هذه الورقة البحثية موضوع حماية المستهلك في مجال المعاملات الالكترونية في الجزائر من خلال قراءة وتحليل نص القانون 18-05 المتعلق بالتجارة الالكترونية والذي سنه المشرع الجزائري من أجل وضع الاطار القانوني المناسب لتنظيم مجال التعاملات الالكترونية في المجال التجاري، وهذا باستنباط أهم القواعد والأدوات القانونية الكفيلة بحماية هذا المستهلك الالكتروني سواء من خلال تحديد وتبيين حقوقه التي نصت عليها بعض المواد من هذا القانون أو من خلال تحديد واجبات المورد الالكتروني وتحديد مسؤولياته. Abstract: Through this paper, we address the issue of consumer protection in the field of electronic transactions in Algeria by reading and analysing the text of law 18-05 on electronic commerce, which was enacted by the Algerian legislature in order to establish the appropriate legal framework for regulating the field of electronic transactions in the commercial field, and this is by devising the most important legal rules and tools to protect this electronic consumer, whether by identifying and determining the rights of certain articles of this law or by identifying the supplier with the duties of electronic.
