أثر الاجتهاد القضائي على حركة التشريع

Résumé: يمثل الاجتهاد القضائي دعامة أساسية لدولة الحق والقانون، كما يمثل ركيزة في مجال الأمن القضائي، فالقضاء باعتباره سلطة من الناحية الإجرائية مثلها مثل بقية السلطات الأخرى في دولة القانون، فإنه أيضا يعتبر مؤثرا في حركة التشريع، بما يمثله من أحكام وقرارات مقومة لأعمال السلطة القضائية في حد ذاتها، وهو ما يطلق عليه الاجتهاد القضائي. Jurisprudence is a fundamental pillar of the State of Law. It also represents a pillar in the field of judicial security. The judiciary is an authority from a procedural point, just like the rest of the other powers in the State of law, on the one hand, and it affects the movement of legislation on the other hand, with what it represents of decisions that adjust the work of the judiciary itself, which is called “jurisprudence”.
