المصطلح القانوني في الجزائر من الاجتهاد القضائي إلى الاجتهاد الترجمي

Résumé: تهدف هذه الدّراسة إلى سبر أغوار التّرجمة القانونيّة في الجزائر، لاسيما ما تعلّق منها بنقل الاجتهادات القضائيّة من اللّغة العربيّة إلى اللّغة الإنجليزيّة، ونخصّ بالذّكر الأحكام القضائية الصادرة عن قسم شؤون الأسرة لما تحمله من مصطلحات قانونية مشحونة بثقافة عربية إسلامية لا نظير لها في النظام القانوني البريطاني الذي اخترناه على سبيل التحليل والمقارنة، قصد إبراز التحديات التي يواجهها المترجم القانوني الجزائري، وما يسهم به من اجتهادات ترجمية لنقل تلك المفاهيم التي قد تغيب عن رجل القضاء البريطاني، على غرار الاجتهادات القضائية التي يسهم بها رجل القضاء لرفع التحديات التي يفرضها النظام القانوني الجزائري. وتوصّلت هذه الدراسة إلى أن الاجتهادات الترجمية في الجزائر لا ترقى إلى مصاف الاجتهادات القضائية بسبب نقص التكوين القانوني ونقص الخبرة في مجال الترجمة القانونية. This study aims to explore legal translation in Algeria, particularly conveying jurisprudence from Arabic into English, especially rulings rendered by the Family Section, as they contain legal terms loaded with Arab-Islamic culture unmatched in the British legal system, which we have chosen for analysis and comparison to highlight the challenges that the Algerian legal translator faces, and the translational efforts exerted by him to convey those notions likely unknown by the British judge, just like jurisprudence brought by the man of law to respond to challenges imposed by the Algerian legal system. This study has concluded that translational diligence in Algeria has not yet reached jurisprudence levels, due to the translator’s lack of legal training and experience in the area of legal translation.
