إجراءات الحجز على العقارات ذات الوضعية الخاصة

Résumé: يعتبر الحجز في عمومه أحد أهم الاليات التي تلجا لها السلطة العامة من اجل استفاء الحقوق وفي المقابل قيامها بهذا الاجراء لابد ان تحترم الإجراءات القانونية اذ لا يمكن اللجوء لحجز العقارات قبل ان تستنفذ الأملاك المنقولة و ذلك للقيمة التي يتمتع بها العقار كونه راس مال من جهة و قد يكون مكان عيش اذا كان هذا العقار منزل وحسنا فعل المشرع الجزائري حين نظم هذا الاجراء ، ولكن الحقوق لابد من استفائها والدائن لابد يستوفي دينه ولا يمكن التذرع باي ذريعة ، ولا يشكل العقار الذي تكون ملكيته وعقوده مستوفاة لشروط الملكية المنصوص عليها في القوانين ، ان الإشكالية التي يواجهها الحجز العقاري هو في العقارات ذات الطبيعة الخاصة ونقصد هنا العقار الغير مشهر والمملوك ملكية على الشياع هذان النوعان يثيراني إشكالية في توقيع الحجز عليهما ، الا ان المشرع من أجل حرصه على صون الحقوق وإعطاء كل ذي حق حقه قد نظم من خلال قانون الإجراءات المدنية والإدارية كل الإجراءات اللازمة لحل هذه الحالات. In general, seizure is considered one of the most important mechanisms that the public authority resorts to in order to fulfill the rights, and in return for carrying out this procedure, legal procedures must be respected, as it is not possible to resort to seizing real estate before the movable property is exhausted, due to the value enjoyed by the real estate being capital on the one hand, and it may be a place to live if this real estate is a house. According to the ownership conditions stipulated in the laws, the problem faced by real estate seizure is in real estate of a special nature Here we mean the property that is not publicized and owned by common people. These two types raise a problem for me in seizing them. However, the legislator, in order to preserve rights and give everyone his right, has organized through the Civil and Administrative Procedures Law all the necessary procedures to resolve these cases
