شروط قبول دعوى إلغاء الدفتر العقاري

Résumé: تعد دعوى إلغاء الدفتر العقاري من الدعاوى البالغة الأهمية لما فيها من حفظ للحقوق، ولهذا أولى المشرع الجزائري اهتماما بالغا بهذه الدعوى وحدد شروط قبولها، وعليه جاءت هذه الدراسة للبحث في هذه الشروط وتسليط الضوء عليها كونها تعد الحجر الأساس لاستفاء الحقوق المتعلقة بالعقار، خاصة وأن الدعاوى المتعلقة بهذا الأخير كثيرة وغالبا ما ترفض لعدم توفر الشروط القانونية المطلوبة. :Abstract The lawsuit to cancel the real estate book is considered one of the most important lawsuits because it contains rights. That is why the Algerian legislator paid great attention to this case and set the conditions for its acceptance, and accordingly this study came to research these conditions and highlight them as they are the cornerstone for the fulfillment of rights related to real estate, especially since the lawsuits Related .to the latter are many and often rejected due to the lack of the required legal conditions
