قسمة التركات بالنسبة المئوية بطريقة القرافي (دراسة مقارنة)

Résumé: يهدف البحث إلى القسمة المباشرة للتركة واستبدال الطريقة السابقة باستعمال النسب المئوية بطريقة بسيطة تستخرج بأول نظر، مع إلغاء التأصيل والتصحيح وذلك في مسائل الميراث المتفق عليها والمختلف فيها، فأقدم لكل نوع من مسائل الميراث قاعدة حسابية بسيطة أشار لها القارافي تُمَكِّن أي شخص يتقن فقه الميراث من تقسيم التركة، فيتوافق ما درسه الطالب في سنوات الدراسة مع ما أقدِّمه في هذا البحث. بمنهج استقرائي مقارن Abstract: The old methods search motivated me to search for percentages to substitute it, likeTa`sil(finding the smallest number that we can subtract the number of heirs without using fractions)andTashih(finding the smallest number that can be divided by the number of heirs without using a fraction). The new methods should allow the calculations of hereditaments; distribution based on percentages. The calculations should consider both the agreed upon and the debatable Islamic laws of inheritanceand bequests. I shall provide a simple methods for each type of the cases of hereditaments` distributions, so that it can be consistent with what students have studied.
