اختصاص محكمة العدل الدولية في تسوية النزاعات الدولية

Résumé: إن موضوع حفظ السلم والأمن الدولي ركيزة أساسية في بناء علاقات أساسية وقوية، وهو من المبادئ الأساسية في ميثاق الأمم المتحدة الذي يعتبر دستور العلاقات الدولية في العصر الحديث، ولعل الحفاظ على هذا المبدأ يستوجب منع أو الحد من النزاعات الدولية التي قد تؤدي الى زعزعة الاستقرار والسلم العالميين. ان الهدف من هذا البحث هو تناول اختصاص محكمة العدل الدولية بالتفصيل في تسوية النزاعات، ومنه الحيلولة دون قيام حرب عالمية، ولابراز هذا الجانب استعنا بالمنهج الوصفي والتحليلي نظرا لأن الدراسة تقتضي بيان ماهية الاختصاصات الممنوحة للمحكمة وفق الفقه والقانون، ولقد توصلنا إلى اعتبار أن المحكمة جهة فاعلة في تسوية النزاعات بين الدول، وأنها تعتبر وفق ميثاق الأمم المتحدة الأداة القضائية الرئيسية للأمم المتحدة. The subject of maintaining international peace and security is an essential pillar in building basic and strong relations, and it is one of the basic principles of the United Nations Charter, which is the constitution of international relations in the modern era. Perhaps preserving this principle requires preventing or limiting international conflicts that may lead to destabilization and peace global. The aim of this research is to deal with the jurisdiction of the International Court of Justice in detail in the settlement of disputes, including the prevention of a global war, and to highlight this aspect we used the descriptive and analytical approach, given that the study requires a statement of what the competencies granted to the court according to jurisprudence and law, and we have come to consider that the court is a body It is effective in settling disputes between states, and it is considered, according to the Charter of the United Nations, the main judicial instrument of the United Nations.
