حل البرلمان في الجزائر (دراسة مقارنة) Dissolution Of Parliament In Algeria (comparative Study)

Résumé: ملخص: يعد حل البرلمان من أخطر الأدوات التي تملكها الحكومة تجاه البرلمان، فهو وسيلة للإنهاء المبتسر للمجلس النيابي قبل اكتمال مدته القانونية تحقيقا لأهداف كثيرة، تتغير بتغير الظروف التي تسود العلاقة بين السلطتين التنفيذية والتشريعية، فقد يلجأ إليه لتحكيم هيئة الناخبين في نزاع طارئ بين السلطتين ينتهي بوقوفهم إلى جانب إحداهما، أو قد يستخدم لجب أغلبية قارة ومنسجمة تساند الحكومة في تنفيذ برنامجها، هذا الأخير الذي يصعب تجسيده على أرض الواقع في غياب أغلبية برلمانية تمدها بالنصوص القانونية. فمشكلة هذه الدراسة تتمثل في الوقوف على صور الحل وخصائصه والضوابط التي يقوم عليها. فهذه الدراسة تهدف إلى تسليط الضوء على صور الحل البرلماني من خلال التطرق إلى الحل الوجوبي والحل الإرادي، كما هدفت إلى دراسة خصائص الحل في الجزائر الذي يتميز بميزتين أساسيتين فهو حل رئاسي ويقع على إحدى غرفتي البرلمان، بالإضافة إلى دراسة ضوابط الحل من خلال التطرق إلى اجراءات حل أحد مجلسي البرلمان وموانع الحل. كلمات مفتاحية: الحل، أدوات الحكومة اتجاه البرلمان، انهاء المجلس النيابي. Abstract: The dissolution of the parliament is one of the most dangerous tools that the government has towards the parliament. It is a means of premature termination of the House of Representatives before the completion of its legal period in order to achieve many objectives, which change with the circumstances that prevail in the relationship between the executive and legislative branches.It may be used to arbitrate the electorate in an emergency dispute between the two authorities that ends with their standing. Besides, one may or may be used to enforce a coherent and consistent majority in support of the Government in the implementation of its program, the latter of which is difficult to materialize on the ground in the absence of a parliamentary majority providing it with legal texts. The problem of this study is to stand on the images of the solution and its characteristics and controls on which it is based. This study aims to shed light on the images of the parliamentary solution by addressing the obligatory and voluntary solution. It also aimed to study the characteristics of the solution in Algeria, which is characterized by two basic features, it is a presidential solution and is located on one of the two chambers of the parliament, in addition to studying the controls of the solution by addressing the procedures.
