الوضع القانوني لمشكلة الحطام الفضائي في القانون الدولي

Résumé: الملخص: الحطام الفضائي هو مشكلة عالمية تتعلق بتراكم الأجزاء المهجورة والغير قابلة للاستخدام في المدارات الفضائية، وتشكل هذه الأجزاء المهجورة التي تشمل أقمارًا اصطناعية قديمة، ومراحل صواريخ، وقطع غير مستخدمة، تهديدًا خطيرًا على الأنشطة الفضائية المستقبلية وسلامة المركبات الفضائية والفضائيين. وتعتبر القضايا القانونية المتعلقة بالحطام الفضائي معقدة وتحتاج إلى التعاون الدولي لحلها، ويتم التعامل مع الحطام الفضائي بموجب القانون الدولي الفضائي، والذي يشمل مجموعة من المبادئ والاتفاقيات التي تحدد حقوق والتزامات الدول في الفضاء الخارجي، من بين أحد المعاهدات الهامة في هذا المجال هي "اتفاقية الأمم المتحدة للفضاء الخارجي"، التي وقعت في عام 1967، من أهم الأحكام التي وردت فيها هي ضرورة تجنب تلوث الفضاء الخارجي والمحافظة على سلامة المركبات الفضائية والفضائيين، علاوة على ذلك، هناك مبادئ وتوجيهات أخرى تحكم الحطام الفضائي، غير أنها غير كافية، ولهذا سنحاول في هذا البحث إيجاد الحلول القانونية لمشكلة تزايد الحطام في الفضاء وسبل الحد منه وإزالته، عبر مختلف نصوص القانون الدولي ودراسة مدى فعاليتها في ذلك. الكلمات المفتاحية: الفضاء الخارجي; الحطام الفضائي; القانون الدولي للفضاء; المسؤولية الدولية. Abstract : Space debris is a global problem related to the accumulation of derelict and non-functional parts in space orbits. This debris, which includes old satellites, rocket stages, and unused fragments, poses a serious threat to future space activities, the safety of spacecraft, and astronauts. Dealing with space debris involves complex legal issues that require international cooperation to solve. The legal framework for addressing space debris is governed by international space law, which includes a set of principles and agreements that define the rights and obligations of states in outer space. One important treaty in this field is the "United Nations Outer Space Treaty," signed in 1967. Among its key provisions is the imperative to avoid the contamination of outer space and to preserve the safety of spacecraft and astronauts. Additionally, there are other principles and guidelines that govern space debris. However, these measures are insufficient, and therefore, we will attempt to find legal solutions to the growing problem of space debris and explore ways to mitigate and remove it through various texts of international law and study their effectiveness in this regard Keywords: Outer space; Space debris ;International space law ;International responsibility.
