موقف القضاء الدولي من الجرائم المرتكبة ضد الروهينغيا

Résumé: الانتهاكات التي تعرضت لها أقلية الروهينغيا في ميانمار، خاصة منذ 2017 بشكل ممنهج ومنظم، من قتل واحتجاز وتعذيب وعنف جنسي وتهجير قسري، وقيود على سبل العيش ...، بما يشكّل إبادة جماعية وجرائم ضد الإنسانية وجرائم حرب، مع تفشي سياسة الإفلات من العقاب على المستوى المحلي، دفع القضاء الدولي للتدخل، من أجل حماية هذه الأقلية ومنع تكرار الانتهاكات ضدها، وذلك من خلال بحث محكمة العدل الدولية في مدى مسؤولية ميانمار عن جريمة الإبادة الجماعية، والمحكمة الجنائية الدولية في مدى المساءلة عن بعض الجرائم كجريمة التهجير القسري. In a systematic and organized manner, the Rohingya have been subjected to serious violations in Myanmar, especially since 2017. In fact, these violations constitute crimes of genocide against humanity, with the absence of accountability and punishment at the local level. This prompted the international judiciary to intervene through the International Court of Justice’s examination of Myanmar’s violation of the Genocide Convention, and by the start of the International Criminal Court to investigate crimes within its jurisdiction, such as forced deportation and persecution. This is recognition of justice and protection for the Rohingya from the repeated violations against them.
