رقابة مجلس الدولة الجزائري على قرارات التأديب الصادرة عن منظمة المحامين الجزائريين

Résumé: حيث من المعلوم أن للقرارات الإدارية بشكل عام وقرار تأديب المحامي بشكل خاص أهمية كبيرة في حماية الصالح العام، وضبط أخلاقيات مهنة المحاماة باعتبارها أحدى أهم المهن في الدولة؛ نظراً للدور المهم الذي تؤديه في حماية حقوق الأشخاص الطبيعية والمعنوية والدفاع عنها، لذلك وضع قانون تنظيم مهنة المحاماة عدة إجراءات لإيقاع العقوبة التأديبية وفرض بعض القيود عليها، وجعل الطعن القضائي في قرار التأديب أمام مجلس الدولة، هذا المجلس الذي يدرس كل جوانب قرار التأديب ثم يصدر حكماً نهائياً فيه يكون ملزماً لجميع الأطراف. It is well known that administrative decisions in general and disciplinary decisions by lawyers in particular are of great importance in the protection of the public interest and the regulation of the ethics of the legal profession as one of the most important professions in the State, given the important role they play in the protection and defence of the rights of natural and moral persons. The Law on the Regulation of the Legal Profession has therefore established several procedures to impose disciplinary sanctions and certain restrictions on them, and to make the judicial appeal against the disciplinary decision before the Council of State, which examines all aspects of the disciplinary decision and then issues a final judgement, which is binding on all parties.
