الإطار القانوني للأوقاف في الجزائر. The Legal Framework Of Endowments In Algeria

Résumé: تبنت الجزائر باعتبارها دولة إسلامية نظام الوقف، لكن الملكية الوقفية في الجزائر عرفت نوع من الإهمال والاندثار وذلك بسبب سياسة الاستعمارية التي حاولت القضاء على هذه المؤسسة، وبعد الاستقلال لم يتم تجسيد الوجود القانوني للأوقاف إلا بصدور القانون 90/25 المتضمن التوجيه العقاري، الذي رتب الأوقاف ثم بعد ذلك جاء قانون الأوقاف 91/10 الذي أقر الحماية القانونية والتسيير والإدارة إلى السلطة المكلفة بالأوقاف، ومن هنا بدأت تتجسد استقلالية القوانين الخاصة بالأوقاف في الجزائر من حيث مختلف الأحكام المتعلقة بها وأيضا إدارتها، ورغم الجهود المبذولة لحماية الأملاك الوقفية، ومحاولة النهوض بها تبقى الجهود متواضعة غير كافية، لذلك لابد من بدل مجهودات أكبر وسن قوانين أكثر صرامة من أجل استرجاع الأملاك الوقفية وحث الشعب على الوقف. Algeria as an Islamic state adopted the Endowment system, but the Endowment property in Algeria knew a kind of neglect and extinction because of the colonial policy that tried to destroy this institution, after independence, the legal existence of the Endowment was not embodied except with the promulgation of Law 25/90 containing the Real Estate Directive which arranged the endowments and then came the Law of endowments 10/91 which approved legal protection administration and steering to the authority in charge of endowments, hence It began to materialize independence of special laws for Endowments in Algeria in terms of the various provisions relating thereto and also its management, and despite efforts to protect Endowment properties, and try to advance them modest efforts remain inadequate, therefore, greater efforts should be made and tougher laws enacted in order to restore the Endowment property he urged the people to Endowment.
