الحماية الدولية من جريمة الاختفاء القسري

Résumé: تهدف هذه الدراسة إلى تحديد الجوانب المفاهيمية لجريمة الاختفاء القسري، التي تعد من أخطر انتهاكات حقوق الإنسان المرتكبة في فترات النزاعات والأزمات الداخلية في الدول، والبحث في الآليات الدولية الكفيلة بمكافحة هذه الجريمة ومعاقبة مرتكبيها. وقد خلصت الدراسة إلى أن الاختفاء القسري جريمة ضد الإنسانية تختص المحكمة الجنائية الدولية بالنظر فيها، كما يمكن تفعيل مبدأ الاختصاص القضائي العالمي لمتابعة مرتكبيها، ويمكن قبل ذلك اللجوء إلى الآليات الوقائية لتفادي وقوع هذه الجريمة. This study aims to determine the conceptual aspects of the crime of enforced disappearance, which is one of the most serious human rights violations committed in periods of internal conflicts and crises in countries, and the international mechanisms to combat this crime and punish its perpetrators. This study concluded that enforced disappearance is a crime against humanity that the international criminal court is competent to consider. It is also possible to activate the principle of universal jurisdiction to pursue its perpetrators, and before that, it is possible to resort to preventive mechanisms to avoid the occurrence of this crime.
