المنهجية الفقهية وسؤال التكامل المعرفي دراسة في مهوم الاجتهاد

Résumé: ملخص: ترتكز المنهجية الفقهية في قراءة النصوص وتفسيرها على مبدأ الوصل بين فقه الوحي وفقه الإنسان بما يحقق مقاصد الشريعة ويقيم المثل العليا للمجتمع. وتأتي هذه الدراسة في مفهوم الاجتهاد بناء على مقتضيات المنهجية الفقهية وتضمين التكامل المعرفي في النظر الاجتهادي المعاصر، وذلكبما يدرأ عنه الانفصال بين قطعيات الشريعة والطبيعة، والنص والواقع، والتناقض مع التراث والحداثة. إن مناهج الاستمداد من معين المعارف والعلوم وتطبيقها في النظر الفقهي هي من قبيل الجمع بين العقل التكليفي والعقل التشريفي الذي ننشده في الاجتهاد المعاصر، ونتحقق به في مقامات تكاملية العلوم. Abstract: The jurisprudential methodology is based on the reading of texts and their interpretation on the principle of linking the jurisprudence of revelation and the jurisprudence of man in order to achieve the purposes of the Shari'a and establish the ideals of society. This study comes in the concept of Ijtihad based on the requirements of the methodology of jurisprudence and include the integration of knowledge in the contemporary jurisprudential view, so as to avoid separation between the pieces of law and nature, text and reality, and the contradiction with heritage and modernity. The methods of deriving from the knowledge and science knowledge and its application in the jurisprudential view are the combination of the cognitive mind and the intellectual mind that we seek in the contemporary Ijtihad, and verify it in the integratory places of science
